According to the Rochester Democrat & Chronicle, Bausch & Lomb is involved in a lawsuit against its insurance companies arising out of the ReNu with MoistureLoc lawsuits. The Democrat reports that attorneys for the insurers maintain that Bausch knew about the problems with its ReNu with MoistureLoc causing infections to injured victims for “several months before the recall” and that any injuries were not accidents.
One can only speculate how long Bausch knew about the problems with their product before enough infections occurred to cause a reason for concern by the foreign and US authorities. When insurance companies deny claims for coverage it is supposed to be after they have conducted an investigation and have a good faith basis to do so.
It is, perhaps, reasonable to conclude that Bausch’s insurance carriers, after conducting their investigation, have concluded that for some period of time while people were suffering serious eye infections, Bausch knew that ReNu with MoistureLoc was injuring innocent victims. If that is the case, once again a “corporate citizen” has placed profits over people.
