DePuy ASR Lawsuit Filed

Last month, Searcy Denney filed a lawsuit on behalf of a North Port hip implant and his wife against DePuy Orthopedics and Johnson & Johnson.  This Southwest Florida resident was originally implanted with a DePuy ASR metal-on-metal hip implant by Dr. Howard Saslow at Fawcett Memorial Hospital in Port Charlotte, Florida in late 2006.  Following the recall of the DePuy ASR hip implant in August of 2010 due to an excessive number of implant failures, the plaintiff was evaluated and found to have pain, fluid collection, and changes consistent with a metal-on-metal reaction to the recalled implant.

The first trial involving DePuy ASR implants was scheduled to begin in December of 2011 in Nevada state court.  There have been rumors that these first cases from Nevada may have been settled.  Additional trials are scheduled in state courts in Maryland, Illinois, California, New Jersey, Minnesota, and Florida.  The first trials in federal court will be presided over by Judge Katz, who oversees MDL No. 2197 and federal courts in the Northern District of Ohio.  The exact locale for the first trials in the MDL has not yet been determined by the judge.
